Bermite Cleanup Impact Seen in Court Ruling

Nossaman Partner and Water Law Practice Group Chair, Fred Fudacz, was quoted in the Los Angeles Daily News in this article discussing the recent U.S. Supreme Court case, United States v. Atlantic Research Corporation. The case affirms the ability of water purveyors and Superfund site owners to recover contamination clean-up costs from polluters and encourages pro-active strategies. This is an important issue to several Nossaman clients who hired the firm to submit an amicus curiae brief in support of the position adopted Monday by the Supreme Court. This is a tremendous outcome for our clients, including the Association of California Water Agencies, the National Association of Water Companies, the California Water Association, the California State Association of Counties, the Castaic Lake Water Agency, the San Gabriel Basin Water Quality Authority, and the Main San Gabriel Basin Watermaster.
