Henry Weinstock Persuades Sixth Circuit to Affirm 7-Figure Judgment for Client PMES

On October 10, 2018, the US Court of Appeals for the Sixth Circuit affirmed a judgment granting Nossaman’s client, PM Engineered Solutions, Inc. (PMES), over $1 million for damages and attorneys' fees on its counterclaim against the plaintiff, Bosal Industries.  

Henry Weinstock, a Partner in the Firm’s Litigation Department, represented PMES in the trial and appeal.  The Sixth Circuit upheld the Ohio district court's ruling that the Connecticut Unfair Trade Practices Act applied to this case, and that Bosal committed unfair or deceptive acts.  The district court's judgment also held Bosal liable for damages for breach of the parties' contract to manufacture truck exhaust flanges, and awarded attorneys' fees and costs: (1) pursuant to the Connecticut Unfair Trade Practices Act; and (2) as sanctions for Bosal's discovery misdeeds.
