As a Partner in Nossaman's Public Utilities Regulatory Practice Group, Mari Davidson represents clients in regulatory proceedings before a number of state and federal agencies, including the California Public Utilities Commission (“CPUC”), the federal Surface Transportation Board (“STB”) and the State Water Resources Control Board (“SWRCB”).  Her work involves rate-setting and rulemaking proceedings, as well as complaint cases, relevant to the water and transportation industries.  Ms. Davidson secures favorable outcomes and approvals for her clients, which include investor-owned public utilities, public agencies, rail carriers and private enterprises, through her specialized knowledge of administrative agency processes.  As a complement to her regulatory practice, Ms. Davidson also advises her clients on corporate issues, compliance concerns and transactional matters.

Ms. Davidson also has a background in public agency law, with experience in drafting public agency procurement documents and contracts, counseling on public meeting requirements, and advising on privacy issues.

Before she joined Nossaman, Ms. Davidson served as Legislative Director to State Senator Bruce McPherson and Associate Consultant to the Senate Committee on Public Safety.  She has also served as a Law Clerk in the California Attorney General's Office of Public Rights, Divisions of Land, Natural Resources and the Environment.

Representative Work

California Water Association.  Represents the statewide association of investor-owned water utilities regulated by the CPUC and the SWRCB in proceedings relevant to emergency preparedness, records confidentiality, drought and conservation, water contamination, and other policy matters impacting the delivery of safe, reliable water service at reasonable rates.  Represents member companies in ratesetting matters, including general rate cases and cost of capital proceedings.

Innovative & Emerging Passenger Carrier Companies.  Represents Zoox, Inc. in the CPUC rulemaking proceeding to establish a framework for pilot testing and deployment of autonomous vehicle technology for commercial service.  Assisted HopSkipDrive, the leading ride service for kids, in securing a CPUC permit to operate as a transportation network company in California.  Represented Sidecar in negotiations to suspend CPUC cease and desist order and in the CPUC ridesharing rulemaking that established first-in-the-nation regulatory authority for a new category of transportation service providers. 

Los Angeles County Metropolitan Transportation Authority.  Represents the Authority in rail crossing and rail safety proceedings before the CPUC in connection with the Authority’s expansion and operation of its passenger transit network in Los Angeles County.

National Railroad Passenger Corporation (Amtrak).  Member of the legal team representing Amtrak before the STB, including in a proceeding to establish terms and compensation for Amtrak’s use of freight rail lines in the provision of passenger train service in the United States.

Water Emergency Transportation Authority. Member of team that serves as General Counsel to water-transportation agency with comprehensive authority over the San Francisco Bay Area's water-transportation system.  Drafted procurement documents for South San Francisco Ferry Terminal opened for ferry service in June 2012.

Bay Area Toll Authority. Member of team providing comprehensive legal and legislative analysis regarding proposed use of video tolling technology for the seven Bay Area bridges managed by the public agency.
