Criminal Export Control and Embargo Actions

The Departments of Justice, State, Commerce, Treasury, and Homeland Security continue to enforce vigorously embargo-related criminal statutes.  Such prosecutions include the transshipment of goods, weapons and economic espionage to Iran, North Korea, and other countries subject to trade embargoes under Executive Orders.

For investigations leading to indictments, the Government relies on the Arms Export Control Act (AECA), the International Traffic in Arms Regulations (ITAR), and the International Economic Powers Act (IEEPA), and frequently asserts related false statement charges.

Nossaman attorneys have significant experience in the defense of these prosecutions.  They have represented clients charged with the transshipment of goods to Iran, including the acquittal of one such client in a jury trial.  They have advised clients under OFAC and ITAR regulations, successfully avoiding the criminal prosecution of such clients.
