Jody Rudman has more than two decades of litigation experience with a specialty in healthcare matters.  With experience on both sides of the docket, Jody has a unique perspective and keen ability to navigate the best result for her clients.  As a specially selected and appointed Special Assistant Attorney General for the State of Texas, she managed the State’s highest-profile healthcare matters, including the litigation of a landmark health law case involving the merger of health insurance companies.  As a federal prosecutor, she pursued claims of fraud and abuse in a variety of health care matters.  In her current role as a defense attorney, she defends healthcare clients in civil and criminal matters, including investigations, lawsuits and indictments, grand jury subpoenas, sentencings, and appeals.  

Jody has represented numerous clients in grand jury investigations and companion civil matters, including intra-investigation hearings and litigation of issues such as the marital privilege, attorney-client privilege, and crime fraud exception.  Representation includes responding to grand jury subpoenas for documents, interviews with law enforcement, advice and counsel on issues of vulnerability and negotiation of litigation stays, pre-indictment pleas, and other resolutions.

Her work also includes advising clients on HIPAA-related matters and navigating the protection of HIPAA information during the course of litigation.

Described by a federal judge as “a great strategist” and “hands down the best legal writer I have ever seen,” her oral advocacy in the courtroom is matched by her written word and tireless dedication to achieving the best results, whether on paper or in front of a judge and jury.

Civil Matters

  • Royal Freight, L.P. v. Pilot Travel Centers, LLC et al.; USA Dry Van Logistics, LLC v. Pilot Travel Centers, LLC, et al.  Represented named defendant who was also involved in an ongoing criminal investigation; litigated Fifth Amendment issues and stay of civil litigation.  
  • Amniotic Therapies LLC v. United States Food and Drug Administration.  Provided local counsel representation in matter involving FDA supervision of biologics.
  • Reyes et al. v. NTTA.  Representation of plaintiff named class representatives and appointment as lead class counsel in federal class action alleging substantive due process violations in connection with imposition and collection of fines and fees for tolls; representation at trial court and on appeal.
  • Medisource Partners, Inc. v. Joseph Nemmers, and Flower Orthopedics Corporation.  Representation of defendants in case alleging breach of non-compete agreements in the health care industry.
  • SEC v. Faulkner at al.  Representation of critical third-party witness during SEC investigation and proceedings by Court-appointed Receiver seeking depositions and sanctions.

Indicted Criminal Cases

  • US v. Bhogavalli.  Obtained complete pretrial dismissal of federal criminal case which had been indicted by grand jury and was set for trial.
  • US v. Hazelwood et al. (Pilot Flying J case).  Multi-year representation of key former employee of Pilot Flying J.
  • US v. Musacchio.  Represented defendant on appeal and identified issues argued on appeal to the Fifth Circuit.  Won a grant of certiorari to the United States Supreme Court Case briefed and argued during the Supreme Court’s 2015 term.
  • US v. Jenkins.  Represented defendant in indicted money laundering conspiracy.  Successfully obtained sentence of probation.
  • US v. Anderson, et al.  Represented defendant in indicted health care fraud and health care fraud conspiracy.  Three week jury trial in Northern District of Texas.  Successfully obtained acquittal on certain counts.
  • US v. Ezukanma.  Representation on appeal to the United States Court of Appeals for the Fifth Circuit in health care fraud case involving Medicare certifications for home health.
