Justin Marks is a railroad regulatory lawyer counseling public agency and private sector railroad clients on transportation regulatory, transactional and litigation issues. 

Mr. Marks advises clients on a range of matters requiring Surface Transportation Board approval such as rail line transactions, abandonments, and rail-banking.  He also provides advice to clients on the scope of federal rail safety laws administered by the Federal Railroad Administration including implementation of Positive Train Control and drafting agency compliant safety programs.

Further, Mr. Marks counsels clients on disagreements related to federal preemption of state and local regulation under the Interstate Commerce Commission Termination Act (ICCTA).

Representative Work

  • Twin Cities Southwest Light Rail Transit Project.  Member of the legal team on the Metropolitan Council’s acquisition of rail line from Canadian Pacific Railway for extension of the METRO Green Line from downtown Minneapolis through the communities of St. Louis Park, Hopkins, Minnetonka, and Eden Prairie.  
  • Jackson County Rock Island Corridor.  Member of the legal team that advised on Jackson County, Missouri’s acquisition of a line of railroad from Union Pacific Railroad and defense of third party Surface Transportation Board challenges to the acquisition.
  • National Railroad Passenger Corporation (Amtrak) – STB Proceedings.  Member of the legal team that represented Amtrak before the Surface Transportation Board.  Mr. Marks is assisting Amtrak in an STB proceeding to establish terms and compensation for Amtrak’s continued use of the rail lines of Canadian National Railway Company.
