Justin Marks counsels passenger and freight railroads, public transit and light rail systems and state and local government agencies on regulatory, transactional and litigation issues.

Mr. Marks has experience representing agriculture, chemical, coal, oil, steel and other heavy industrial shippers on matters related to rail-served facilities governed by the Surface Transportation Board, the Federal Railroad Administration, and/or the Pipeline and Hazardous Materials Safety Administration.

Mr. Marks first gained exposure to transportation issues while working as a law clerk for a national transportation firm that represented transit authorities and airports. In law school, he served as the Editor-in-Chief of the Transportation Law Journal.  

Representative Work

  • California High-Speed Rail Authority – STB Authorization/ICCTA Preemption. Member of the legal team advising the Authority in Surface Transportation Board authorization and ICCTA preemption matters.  The $68 billion high-speed rail program, the first such system in North America and one of the world’s largest infrastructure projects, will connect the state’s urban centers with nine segments running through the Bay Area, Central Valley, Inland Empire and Southern California.   Mr. Marks is assisting the Authority to secure STB authorization for construction of track and facilities in the Central Valley and to effectively use ICCTA preemption to expedite permitting and environmental clearance of the planned system.
  • National Railroad Passenger Corporation (Amtrak) – STB Proceedings.  Member of the legal team representing Amtrak before the Surface Transportation Board.  Amtrak provides intercity passenger train service in the United States, operating 374 trains each day on 31,500 miles of track in 46 states and three Canadian provinces.  Off the Northeast Corridor, Amtrak operates on lines owned by other railroads.  Mr. Marks is assisting Amtrak in an STB proceeding to establish terms and compensation for Amtrak’s continued use of the rail lines of Canadian National Railway Company and two additional investigations of the substandard on-time performance of the Amtrak’s Illini/Saluki® and Capitol Limited® services.
