Former Department of Justice Attorney Available for Comment on Today's Supreme Court Decision in Cooper Industries, Inc. v. Aviall Services, Inc.

ORANGE COUNTY (December 13, 2004) - Paul Weiland, a former Department of Justice attorney, is available to comment on today's Supreme Court decision in Cooper Industries, Inc. v. Aviall Services, Inc., No. 02-1192. Mr. Weiland was co-counsel for the United States during the proceedings in the Supreme Court and Fifth Circuit Court of Appeals.

The court adopted the position advocated by the United States as amicus curiae that a private party who has not been subject to a civil action under section 106 or 107(a) of the Comprehensive Environmental Response, Compensation, and Liability Act (commonly referred to as Superfund) cannot seek contribution from other liable parties.

The decision has important implications for those involved in the cleanup of hazardous waste sites, including brownfields, many former Department of Defense installations, and groundwater. According to Weiland: "Like a number of other recent decisions by the Court in environmental cases, Cooper v. Aviall is a narrow holding that addresses a precise question. As a result, the decision arguably raises more issues than it resolves."

Mr. Weiland worked in the Law and Policy Section within the Environmental & Natural Resources Division of the U.S. Department of Justice in Washington, D.C. While at the Department of Justice, Mr. Weiland represented the United States in appellate and trial environmental litigation. He recently joined Nossaman Guthner Knox & Elliott's Land Use and Environmental Practice Group.
