Edward Fishman helps public and private clients develop large-scale, sophisticated infrastructure projects through innovative methods, particularly in the transportation sector.

He provides project structuring and risk management advice on rail, highway and related intermodal projects and has handled several public-private partnership (P3) and joint venture transactions.  Clients also rely on Mr. Fishman’s experience with procurement, licensing, safety, labor, environmental clearance and other regulatory matters associated with such projects.

Additionally, he offers substantial expertise with the Foreign Corrupt Practices Act (FCPA), export control and other U.S. laws that apply to business activities outside the country.  Mr. Fishman has conducted global internal investigations relating to the FCPA, internal fraud, auditor independence and financial accounting irregularities for a variety of public and private companies.

Representative Work

Mr. Fishman provides regulatory, transactional and risk management advice on railroad, highway, public transit and other infrastructure projects, particularly in the transportation and logistics industry. He has represented numerous private sector and public sector clients in the railroad, trucking and logistics sector in connection with regulatory compliance matters, project approvals and commercial contract negotiations.  His representative experience in the infrastructure sector includes the following projects:

  • Utah Transit Authority.  Counseled UTA in connection with regulatory matters arising before the Surface Transportation Board, Federal Railroad Administration and Federal Transit Administration.
  • Dallas Area Rapid Transit.  Advised DART in connection with acquisition of freight railroad corridors for passenger rail usage and related regulatory and transactional issues. 
  • City of Cincinnati.  Represented City in the contract negotiations for developing a design-build-finance-operate streetcar project with a private consortium.
  •  I-15 HOT Lanes Project (Utah).  Advised private consortium bidding on a design-build electronic toll collection project developed by the Utah Department of Transportation.
  • WMATA Parking Garage Project.  Represented private sector bidder on a performance-based DBFO procurement issued by the Washington Metropolitan Area Transit Authority.
