Winning an Insurance Battle without Losing the War

When Genstar's insurance company tried to collect retroactive premiums on a policy that covered a company Genstar had spun off, we stepped in and solved their problem. The insurance company had paid Chemstar – the spin-off – just the minimum to cover a legitimate construction defect claim, while suing parent company Genstar to pay premiums for the maximum coverage payments. We countersued for bad faith.

Through meticulous discovery and detailed depositions, we demonstrated Genstar's insurance company was talking out of both sides of its mouth and covering their deception with opaque billing practices. Time was of the essence for Genstar. They wanted to settle before the court ruled on other issues that could have negatively affected the company, not just on the case at hand, but on several other cases. Because of the strong evidence we had uncovered, the insurance company promptly settled on terms favorable to our client.
