Nossaman Noted In Orange County Register For Win In Coastal Commission Dispute

The work of a Nossaman team made up of Environment and Land Use Practice Group members—Partners John Flynn and Steven Kaufmann—was noted in the Orange County Register article, Laguna Beach Homeowners Win Reprieve In Tearing Down Seawall Protecting House.

The Register reported that in August, the Coastal Commission ordered that the Firm’s client remove a seawall in front of their residence and imposed a $1 million fine due to allegedly unpermitted work. In September, Orange County Superior Court Judge Randall J. Sherman ruled that there would be no fine or seawall removal until the client’s case was heard, and set a trial date of June 17, 2019. Commenting on the Judge’s ruling, Mr. Kaufmann said, It’s an appropriate outcome.

In the dispute, the Register noted that Laguna Beach and the Coastal Commission appear to be at odds—with the Laguna Beach Community Development Director saying that the project was exempt from a Commission permit. Regarding this point, Mr. Kaufmann stated that he thinks there are unresolved issues between the city and the commission. It’s my belief the two sides should be reconciling these differences so that property owners [like our client] know the rules.
